this indenture made 18.12.1647 between Robt Cell of Earls Colne wheelwright of the one part and Wm Cell his son of the same town and county wheelwright in the other part witnesseth that the said Robt Cell as well for natural love and affection which he beareth unto the said Wm his son and also for and in consideration and upon condition of the yearly rent or annuity of 4li of good and lawful money of England hereafter in these presents mentioned to be paid unto the said Robt Cell and Ann his now wife or their assigns for and during the term of the natural life or lives of the longer liver of them both as also for divers other good causes considerations conditions and agreements hereafter taken to be performed and here in these presents mentioned expected or contained has given granted aliened bargained and sold enfeoffed confirmed and delivered and by these presents do fully freely and absolutely give grant alien bargain sell enfeoff confirm and deliver the said Wm Cell all that his freehold messuage or tenement and croft of land with all and singular every of the houses edifices buildings yards or gardens and all other the appurtenances thereunto belonging whatsoever set lying and being in Earls Colne aforesaid between the land of the Prior and Convent of the same town called Spillwaters Land on the one side and the land sometimes Jn Paycock's of Coggeshall and afterwards Robt Goldwire's on the other side one head thereof abutteth upon the kings highway leading from Earls Colne aforesaid towards Colchester and the other head thereof abuts upon the lane called Perse Mell Lane which said messuage tenement and parcel of freehold land with appurtenances the said Robt Cell did buy and purchase of Jn Middleton senior the father and Jn Middleton junior the son sometimes of Earls Colne aforesaid bricklayers as in and by one pair of indentures bearing date 25.1.1622 it doth more at large and plainly appear to have and to hold the said messuage or tenement and croft of land and all other the appurtenances whatsoever unto belonging unto the said Wm Cell and his heirs forever except and always reserved out of this present indenture of bargain and sale all that part of the said messuage or tenement and garden being at the west end of the said messuage and garden now sold unto Wm Cook and Susan his wife the daughter of the said Robt Cell and now in their occupation being lately built as in and by one pair of indentures bearing dates with these presents more at large and plainly appear provided always and upon these conditions hereafter following viz that is to say that if the said Wm Cell or his lawful attorney his heirs executors administrators or assigns or any one of them do and shall well and truly satisfy content and pay or cause to be paid to the said Robt Cell and Ann his now wife or to his assigns the yearly rent or annuity of 4li of good and lawful money of England every year during their natural life or lives of the longest liver of them the said Robt and Ann at the four most usual feast days or term in the year that is to say o n the feast day of the annunciation st jn the baptist st michael the archangel and the nativity of christ commonly called christmas day by even and equal portions that is to say the sum of 20s of good and lawful money of England at every of the said feast days in or at the now dwelling house of the said Robt Cell situate in Earls Colne aforesaid and also upon condition that the said Wm Cell his heirs or assigns shall permit or suffer the said Robt Cell and his wife his father and mother to have their dwelling in the said messuage or tenement with free liberty of ingress and egress and regress and into all singular every of the rooms houses yards gardens and parcel of land of the appurtenances also to have and take one half of the fruit apples pears plums corn grass or crop whatsoever it shall please god that shall at any time hereafter arise grow or increase on any piece of the same premises every year during the natural life of the longer liver of them the said Robt and Ann without the lawful threat hindrance molestation trouble or any manner of encumbrance of the said Wm Cell his heirs or assigns or by his or their means consent or procurement and I the said Robt Cell and my heirs the aforesaid messuage or tenement and croft of land with appurtenances unto the said Wm Cell and his heirs under the considerations conditions and agreements abovesaid against me and my heirs will warrant and defend forever hereafter by these presents to hold of the chief lord or lords of the fee or fees there by the yearly rent of 4d and such other services as are or shall be due and of right accustomed in witness whereof the parties abovesaid to these presents have set their hands and seals the day and month and year above written mark Robt Cell (there are two copies of this deed but only one contains any signature or mark)
