memorandum that I Jn Garrett of Earls Colne in the county of Essex gent being very aged and sick but of sound mind and memory make this my last will and testament as followeth item I give unto my kinswoman Judith Garrett daughter of my late brother Albrey Garrett all that my copyhold messuage cottage or tenement lately built and 7a of land more or less called Thredgolds Fenne late parcel of certain lands called Thredgolds and are holden of the manor of Colne Pryory and also certain copyhold lands called Chewneyland with the appurtenances containing by estimation 9a and also certain copyhold lands and tenement called Parkefeild and Chewney with the appurtenances held of the manor of Earls Colne and now in the occupation of Xoph Ellis to hold the said messuage lands and all other the premises with the appurtenances unto the said Judith and to her heirs forever upon condition that Abrm Christmas the younger and Jn Garrett son of my brother Wm Garrett shall receive the rents and profits thereof for the term of three years immediately next after my decease for and towards the payment of the fine and other charges item I give unto Abrm Christmas the younger and to his heirs forever one moiety or half part of the freehold messuage wherein I now lie called Thredgolds otherwise Malloryes being the east end abutting upon the widow Isazons tenement with free passage through the entry into the street or yards and also the yard lying on that side where the end of the house stands and also half the great barn being the east end with liberty and use of the floor of the said barn to carry in corn and thresh the same there upon or any other such like lawful occasion at all reasonable and convenient times item I give unto the said Abrm Christmas my freehold orchard containing 2r lying on the east side next the vicarage to hold the same unto the said Abrm Christmas and his heirs also I give more unto the said Abrm Christmas and his heirs forever one strip of copyhold land holden of the manor of Colne Pryory containing 1a and abuts eastward towards the land of mr Edw Abbutt and southward upon the said freehold orchard herein before given to the said Abrm also I give more unto the said Abrm and to his heirs forever one copyhold field containing 5a more or less abutting northward upon certain lands called St Mary Crofts belonging also to Colne Priory and westward upon certain lands called Buners J Garrett (signature is scratchy) v (inserted) to have and to hold the said moiety of the said messuage barn and also all the lands tenements and hereditaments whatsoever herein before to the said Abrm herein and hereby bequeathed or mentioned to be bequeathed to the uses intents trusts and purposes hereafter mentioned that is to say to the use of the said Abrm Christmas the younger for and during the term of his natural life and from and after his decease to the use of the heirs of the body of the said Abrm lawfully to be begotten and from and after his decease and the death of the heirs of his body in case he shall leave any to the use of Jn Garrett son of my brother Wm Garrett and to the heirs of his body lawfully to be begotten and for want of such issue to the use of Jn Garrett son of my brother Gamaliel Garrett and to his heirs forever provided always and my will and meaning is that my sister Jane Christmas mother of the said Abrm shall have her dwelling in the said moiety or part of the said messuage given to her said son during the term of her natural life upon condition that the said Jane shall yearly during her life pay unto Margt Sexton during the term of her life at the two most usual feasts in the year that is to say the feast of michaelmas and annunciation 10s of lawful money of England that is to say 20s every year and also my further will and meaning is that the said Abrm Christmas shall well and truly pay or cause to be paid unto Sam Christmas his brother the sum of 20li of lawful money of England when he shall accomplish his age of 21yr but if default of payment shall be made in payment of either of the said sums herein before mentioned then it shall be lawful for the person or persons to whom the same shall be due to enter into and upon the lands or any part herein before given to the said Abrm Christmas and the J Garrett (inserted) same to hold and enjoy until he she or they be fully paid item I give and bequeath unto Jn Garrett son of my brother Wm Garrett and to his heirs forever the other part of my freehold messuage wherein I now dwell called Thredgolds otherwise Malloryes with the maltinghouse hayhouse little barn strawhouse and half the great barn being the end lying westward and abutting upon a certain copyhold messuage tenement and yard belonging to Geo Toller with liberty of passage through the entry and yards and through the porch into the said barn as it now stands also I give and bequeath unto the said Jn Garrett son of my said brother Wm my little freehold field which was formerly Barth Clarke's containing 1a or thereabouts from the pale which divideth the other part whereon a brick house stands being already disposed of item I give more unto the said Jn Garrett my kinsman and to his heirs forever all that my copyhold field called the Barnefeild lying behind the barn containing by estimation 4a more or less and also one other field adjoining thereunto next the land leading from Earls Colne to Colne Engaine containing 3a more or less upon condition that the said Jn Garrett shall pay unto Jn Garrett son of my brother Gamaliel Garrett 30li of lawful money of England when he shall accomplish his age of 21yr item I give and bequeath unto Jn Garrett son of my brother Gamaliel Garrett and to his heirs forever all that my copyhold messuage or tenement called Clovers with the appurtenances now in the several occupation of Robt Pennocoke the widow Garrett and Thos Wyseman and lastly my will and meaning is this that the said Judith Garrett shall have paid unto her yearly and every year during the term J Garrett (inserted) of five years paid unto her by the said Abrm Christmas and Jn Garrett the sum of 40s and also that Eliz Hatch wife of Barth Hatch and Judith Rayner widow and each of them shall have yearly paid unto them during their natural lives 20s apiece out of the rents and profits of the messuage lands herein before devised to the said Judith my kinswoman at the two most usual term in the year that is michaelmas and annunciation by equal portions and if default be made it shall be lawful either for the said Eliz Hatch or Judith Reyner to enter upon the said messuage and premises given to the said Judith and the same to hold and enjoy till such their legacy arrears and charge shall be fully paid in witness whereof I the said
