in the name of god amen I Mary Smith of Earls Colne in the county of Essex widow being in good health and of sound mind memory and understanding praise be god for the same do make and declare this my last will and testament in manner and form following that is to say first I commend my soul into the hands of almighty god my creator hoping for pardon of all my sins through the merits and intercession of my blessed lord and saviour Jesus Christ and my body I commit to the earth to be decently buried at the discretion of my executrix hereinafter named and as to the worldly estate which it hath pleased god to bestow upon me I dispose thereof as follows that is to say first I give and bequeath unto my daughter Ann Smith the sum of 120li of lawful money of Great Britain and I do hereby authorise empower and direct my executrix hereinafter named her executors or administrators as soon as conveniently may be next after my decease to make sale of all those messuages or tenements with the yards gardens and appurtenances thereunto belonging both freehold and copyhold situate lying and being in Earls Colne aforesaid near the churchyard there and now in the several tenures or occupations of Sarah Stowers and Wm Gladwin their undertenants of assigns and also all that copyhold messuage or tenement called Firmin Tylers and croft called Olivers Croft with the yards gardens and appurtenances thereunto belonging also situate lying and being in Earls Colne aforesaid and not in the several tenures or occupations of Rich Foakes and Edw Marvell or their assigns for the best price or prices that can or may be had or gotten for the same respectively and to apply and dispose of the monies arising by such sale for and towards payment and satisfaction of my just debts funeral charges and the charges of proving this my will and the remainder of the monies if any I give and bequeath unto my daughters Mary Harrington and the said Ann Smith and Eliz Chaplyn equally to be divided between them share and share alike all my household goods and furniture stock in trade and also all other my goods chattels and personal estate whatsoever and wheresoever I give and bequeath unto my said daughters Ann Smith Eliz Chaplyn and Mary Harrington equally to be distributed amongst them share and share alike and I do hereby nominate constitute and appoint my said daughter Ann Smith sole executrix of this my last will and testament in witness whereof I have hereunto set my hand and seal this 25.8.1766 Mary Smith signed sealed published and declared by the said Mary Smith the testatrix as and for her last will and testament in the presence of us who at her request in her presence and in the presence of each other of us have subscribed our names as witnesses thereto Geo Peach Eliz Peach Wm Turner
