it is shown by the homage that Hen Makinge out of court viz on 7.3.1625 surrendered into the hands of the lord by the hands of Jn Read instead of the bailiff in the presence of Edw Potter and Robt Crowe two customary tenants the same testifying according to the custom of the said manor one cottage with appurtenances lying in Earls Colne now in the occupation of Jn Pennocke to the use and behoof of the aforesaid Jn Pennocke and his heirs upon this condition that if the aforesaid Hen Makinge his heirs executors administrators or assigns should well and truly pay or cause to be paid to the aforesaid Jn Pennocke his heirs executors or assigns the sum of 13li in or at the dwelling house of the aforesaid Jn Pennock situated in Earls Colne aforesaid in or upon the 8.3.1626 that then this surrender should be void and have no force in law but otherwise it should stand in full force and effect etc
