whereas at a court here held 1.11.1653 Sam Burton took for himself and his heirs by copy of court roll one messuage or tenement called Seabrights with appurtenances and whereas at a court here held 19.10.1659 it was presented by the homage that the said Sam after the then last court viz on 8.10.1659 surrendered into the hands of the lord by the hands of Jn Brewer instead of the bailiff and in the presence of Geo Cressner senior and Jn Clerke two customary tenants of the said manor the same testifying the said messuage or tenement with appurtenances then in the tenure or occupation of Esdras Peartree (may be Esdras Peartree) to the wishes and uses of his last will and testament now at this court it was presented by the homage that the said Sam Burton after the last court died seised thereof upon which came here into court Ann Burton widow and late wife of the said Sam in person and Wm Burton son of the said Sam by Geo Cressner in the part of his attorney and deputy and brought here into court the testament and last will of the said Sam as they say in writing bearing the date 8.10.1659 the tenor of which as far as the premises in the following English words item I give to Ann my wife for her natural life my copyhold messuage or tenement with the yard and every of their appurtenances thereunto belonging now in the tenure or occupation of Esdras Peartree (may be Esdras Peartree) or his assigns and after her decease I give the same to my son Wm and to his heirs and in case he dieth before his age of twenty one years I give the same to my son Dan and to his heirs forever as by the testament and the said last will it is clearly shown and upon this the said Ann in person and the said Wm by his attorney and deputy humbly sought admittance as tenants of the premises to whom the same Ann in person and the said Wm Burton by the hands of his attorney and deputy the lord by the said steward granted and delivered thereof seisin by the rod to have and to hold the said premises with appurtenances to the said Ann for her lifetime and after her decease to the said Wm his heirs and assigns forever according to the tenor and effect of the said testament and last will from the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs thereunto belonging and by right accustomed and they gave to the lord their fines
