in the name of god amen the 5.4.1621 etc. I Jn Newton of Earls Colne in the county of Essex do ordain and make this my last will and testament in manner and form following first I bequeath my soul into the hands of almighty god my creator with an assured trust to receive forgiveness of my sins through the death and passion of jesus christ my saviour and redeemer and my body to be decently buried in christian burial within the parish churchyard of Earls Colne aforesaid item I give and bequeath unto the poor people of the parish of Earls Colne aforesaid the sum of 5s of lawful money of England item I give and bequeath unto Sam Newton my son and to his heirs my tenement late Wm Spriggs now in the tenure and occupation of Edw Newton my brother and if it shall fortune that Sam Newton my son do depart this natural life before he shall attain to the full age of 21yr then I give and bequeath the said tenement with the appurtenances unto Edw Newton my brother and to his heirs item I do give and bequeath unto Sam Newton my son my bed and bedstead as it is furnished now standing and being in the parlour and the long table in the said parlour to be delivered unto him by mine executrix at his age of 21yr item I give and bequeath unto Sam Newton my son the sum of 30li of lawful money of England to be paid by mine executrix at his full age of 21yr and if it shall fortune the said Sam Newton my son do depart this natural life before he shall attain the said age of 21yr then my will and meaning is that 25li of lawful money of England part of the foresaid 30li shall be equally divided to and amongst Franc Newton son of Franc Newton Jn Scot the younger Wm Pennock son of Jn Pennock Eliz Newton Frances Newton daughters of Edw Newton Wm Deeks son of Wm Deeks and Margt Deeks daughter of Roger Deeks or to so many of them as shall then living to be paid unto them at such time as the foresaid Sam should be paid the foresaid 30li and my will and meaning is that Edw Newton my brother shall pay this last quarter rent when it is due for the house wherein he now dwelleth and from that time until the feast day of michaelmas next coming he shall pay no rent for the dwelling in the foresaid tenement all the rest of movable goods whatsoever I give and bequeath unto Eliz my wife for and towards the paying and discharging of the fine which shall be due after my decease unto the lord of the manor for the admittance of the foresaid Sam unto the aforesaid tenement late Wm Spriggs and also for and towards the bringing up of the said Sam my son until he shall attain unto the full age of 14yr and I do ordain and make the said Eliz my wife sole executrix of this my last will and testament my will and meaning is that Eliz my wife shall keep and maintain the foresaid tenement before given and bequeathed unto the said Sam Newton my son in all manner of needful and necessary reparations until such time as he shall attain to the age of 14yr in witness whereof I have hereunto set my hand and seal the day and year aforesaid sealed and subscribed in the presence of Jn Hauksbee Wm Dashe Jn Newton
