whereas at a court here held 1.4.1609 Jn Prentice was admitted for himself and his heirs to one parcel of land with appurtenances containing 7a of land more or less etc as by the metes and bounds etc now at this court it is shown by the homage that after the last court and before this court the aforesaid Jn Prentice died seised of the aforesaid premises among others which before his death he surrendered the aforesaid premises into the hands of the lord by the hands of Jeff Potter instead of the bailiff in the presence of Jn Read and Rich Kempe two customary tenants of this manor the same testifying according to the custom of the aforesaid manor to the use and behoof of his last will and testament by which same said last will here in court produced and showing under the official and lawful seal bearing the date 8.11.last it is clearly shown that the aforesaid Jn Prentice gave and bequeathed the aforesaid premises among others in the following manner and form the tenor of which his last will and testament concerning the premises in the following english word item I give and bequeath unto Jn Prentice my son and to his heirs all those my lands both free and copy which are lying and being in the parish of Earls Colne and if is shall happen that that child wherewith my said wife doth think she is withal at this instant of at this time of writing herewith that then I do give and bequeath unto the said child be it boy or girl the full and entire sum of 40li of good and lawful money of England to be paid by my son Jn Prentice his heirs or assigns out of the said lands at the full age of twenty one years and also my will and mind is that my executors shall peaceably and quietly enjoy all those my lands and pastures without any strip or waste for and toward the paying of my debts until such time as my said son shall come to the age of twenty one years and the remainder and overplus of my said lands my mind is that my now wife shall have towards the bringing up of my child or children towards their maintenance and furthermore the aforesaid homage present that Jn Prentice the son of the aforesaid Jn is the next heir of the aforesaid Jn and aged 1yr9mths and also to this court came Clem Turnor in person to whom by the lord of this manor's agreement both the custody of the body of the aforesaid Jn Prentice and the aforesaid premises were committed until the aforesaid Jn Prentice should reach his full age of twenty one years then to return to him an account of the profits and upon this the aforesaid Clem Turner gave to the lord his fine for such his estate and was admitted guardian of the aforesaid Jn Prentice until etc
