this indenture made 1.1.12Geo2 1739 between Jn Wale the younger of the Inner Temple London esq of the one part Hezekiah Haines of Copford Essex esq and Jn Holgate of London druggist of the other part witnesseth that the said Jn Wale for and in consideration of the sum of 5s of lawful English money to him in hand paid by the said Hezekiah Haines and Jn Holgate the receipt whereof he doth hereby acknowledge and for divers other good causes and valuable considerations him thereunto moving hath bargained and sold and by these presents doth bargain and sell unto the said Hezekiah Haines and Jn Holgate their executors and administrators all that undivided moiety or full half part of the whole in two parts to be divided of the manor or lordship of Earls Colne with the rights members and appurtenances thereof in the county of Essex and all that the undivided moiety or full half part of the whole in two parts to be divided of the manor or lordship of Colne called the manor or lordship of Colne Priory with the rights members and appurtenances thereof in the said county of Essex and all those two third parts the whole in three equal parts to be divided of all that rectory impropriate of Earls Colne aforesaid and all that capital messuage called Colne Priory with yards gardens and appurtenances thereunto belonging and all that the advowson free disposition or right of patronage of the parish church of Earls Colne and all that mill called Colneford Mill and 3a of meadow thereunto belonging and all those two crofts of land called St Marys Croft containing 14a more or less and all that croft called Thorns Croft and all that croft called Birds Croft and all that croft called Church Croft and all that meadow called Newland Meadow containing by estimation 11a and all that field called Great Field containing by estimation 18a and all that croft called Rush Croft and all those lands called the Pightles and Warren Fields containing by estimation 17a and all those hop grounds now planted with hops called Chiffin containing by estimation 19a and all that parcel of land called Milles heretofore planted with hops and all those four closes of land called Bunners containing by estimation 24a and all that part of the great wood or wood ground called Chalkney Wood lying towards the east sometime since divided and separated by a ditch from the residue of the said wood lying towards the west being two parts of the said wood the whole in three parts divided containing 120a and all those lands and grounds called Ten Acres and Ten Acre Farm containing by estimation 54a and all that messuage or dwelling house called Carters with appurtenances and all that croft of land called Pitcroft and all that house and mill called Chalkney Mill and the lands thereunto belonging containing by estimation 13a and all that farm called Millses and Coppins with the lands hereditaments and appurtenances thereunto belonging or therewith used or enjoyed and all those lands called Chalkney Crofts and all that wood called Hansers Hedge and all that croft called Olmstead containing by estimation 184a and all other the messuages lands meadows pastures woods hopgrounds tenements and hereditaments late of mrs Mary Androws the grandmother of the said Jn Wale which now are in the tenure of the said Jn Wale Jn May Jn Tiffin Thos Sewell Jas Bradbrook and Edw Wash or any of them their or any of their assignee or assigns all which said messuages lands and premises are situate lying and being in the parishes of Earls Colne Colne Engaine and White Colne or some of them or some other parish or parishes near adjoining and all tithes both great and small yearly issuing arising and renewing out of such part of all and every the aforesaid messuages mills lands meadows pastures hopgrounds wood grounds and premises herein before mentioned to be granted and released as are situate lying and being in the said parish of Earls Colne and all messuages edifices buildings barns stables kilns dovehouses yards gardens orchards ways waters easements profits and appurtenances to the said capital messuage and several messuages lands tenements and hereditaments belonging or appertaining or therewith now used or enjoyed as part parcel or member thereof and all courts profits and perquisites of court leet views of frankpledge and what to view of frankpledge doth b elong waifs estray deodands goods and chattels of felons felons of themselves and outlawed persons huntings hawkings fishings fowlings rents service s wastes waste grounds reliefs amercements franchises royalties profits and hereditaments whatsoever with the appurtenances to the said undivided moieties of the said manor or lordships or either of them belonging or therewith or with either of them used or enjoyed as part parcel or member thereof and the reversion and reversions remainder and remainders thereof and of every part and parcel thereof to have and to hold the said undivided moieties of the said manor or lordships the said two third parts of the said rectory impropriate and all the said capital messuage and advowson of the said vicarage messuages mills farms lands tithes tenements and all and singular other the hereditaments and premises herein before mentioned and intended to be hereby bargained and sold with their and every of their rights royalties members and appurtenances unto the said Hezekiah Haines and Jn Holgate their executors administrators and assigns from the day next before the day of the date of these presents for and during the full time and term of one whole year from thence next ensuing and fully to be complete and ended yielding and paying therefore upon the last day of the said term the rent of one peppercorn if lawfully demanded to the intent and purpose that by virtue of these presents and by force of the statute for transferring of uses into possession the said Hezekiah Haines and Jn Holgate may be in the actual possession of all and every the said premises and may be thereby enabled to accept and take a grant and release of the reversion and inheritance thereof to them and their heirs to the uses in the said release to be mentioned expressed and declared in witness whereof the parties first above named have to these presents interchangeably set their hands and seals the day and year first above written Jn L S Wale
