this indenture made the 29.9.1668 etc between Jn Browne of Earls Colne in the county of Essex husbandman and Alice Alen of the same widow of the one part and Wm Newton of the same shoemaker of the other part whereas Rich Harlakenden late of Earls Colne in the county of Essex esq by his indenture of lease bearing date the 26.3.16Jas1 for divers causes and considerations him thereunto moving did demise betake and to farm let unto Mich Hayward of Colne Engaine in the county of Essex yeoman all that cottage or tenement with the curtilage or yard thereunto belonging lying on the south west side of the street called Holstreete containing by estimation 15p (pikes) more or less then in the tenure or occupation of     Kendall widow to have and to hold the said demised cottage or tenement with the appurtenances to the said Mich Hayward his executors and assigns from the feast day of st michael the archangel then next ensuing the date thereof until the full end and term of one thousand years from thence next ensuing and fully to be completed and ended without impeachment of for or concerning any manner of waste to be done or committed of in or upon the same yielding and paying therefore yearly during the same term unto the said Rich Harlakenden his heirs or assigns one peppercorn at the feast of st michael the archangel if it shall be lawfully demanded as by the said indenture of demise relation being thereunto had amongst divers other covenants grants articles and agreements more at large appeareth the estate right title interest term of years property claim and demand of him the said Mich Hayward of and unto the said demised premises is such illegible text then lawfully come to the hands and possession of the forenamed Jn Browne and Alice Alen or one of them by virtue of (worn away at a fold) or illegible text the said demise made between the said Mich Hayward of the one part and the said Jn Browne of the other as by the said writing also bearing date the 1.7.11Chas1 relation being thereunto had more fully and at large it doth and may appear now this indenture further witnesseth that the said Jn Browne and Alice Alen for and in consi deration of the sum of 36li of lawful english money to them or one of them in hand paid by the said Wm Newton before the ensealing and delivery of these presents the receipt whereof and the livery part thereof the said Jn and Alice hereof acknowledge to have had and received and of every part and parcel thereof do fully acquit and discharge the said Wm Newton his executors and administrators by these presents hath given granted bargained sold assigned and set over and by these presents do for them their executors administrators and assigns give grant bargain sell assign and set over unto the said Wm Newton his executors and administrators and assigns all the estate right title interest term of years property claim and demand whatsoever of them the said Jn Browne and Alice Alen and either of them of in and to the forementioned demised cottage or tenement yard and premises with the appurtenances which they the said Jn Browne and Alice Alen or either of them now hath or heretofore had or may or can have by virtue of the said demises or assignments or by any other ways or means whatsoever to the only proper use and behoof of him the said Wm Newton and Jane his wife for and during the term of their natural lives and the longer liver of them they and either of them keeping the same in good and tenantable repair and afterwards to the proper use and behoof of him the said Wm Newton his heirs and assigns for and during the residue and remainder of the said term of one thousand years yet to come and unexpired in the said indenture of demise first above mentioned (torn) for themselves or either of them their executors and administrators do covenant promise and grant to and with the said Wm Newton his executors administrators and assigns (torn) by these presents that they the said Jn Browne and Alice Alen or one of them for and notwithstanding any act or thing done by them or their means consent or procurement have good right full power and authority to bargain sell and assure over the premises for the residue of the said time and term yet to come and unexpired of the said demise unto the said Wm Newton his heirs and assigns in manner aforesaid and that the said Wm Newton his executors administrators and assigns shall and may quietly and peaceably have hold and enjoy all and every the premises with the appurtenances in the said indenture of demise mentioned for and during the term aforesaid for and notwithstanding any act or thing done or committed by them the said Jn Browne or Alice Alen or any other person claiming by from or under them or either of them and that they and either of them shall and will from time to time and at all times hereafter upon reasonable request of him the said Wm Newton his executors or assigns within the space of ten years make do acknowledge or cause to be made done and acknowledged by such further or other act or acts assurance or assurances in the law as by learned counsel shall be advised for the better assigning over and suremaking of the premises unto the said Wm Newton hi s executors administrators and assigns for the term aforesaid according to the true intent and meaning thereof in witness whereof the parties memorandum that I the within named Wm Newton for and in consideration of the sum of 26li of lawful money of England to him in hand paid by Hen Hatch of Earls Colne in the county of Essex butcher have given granted bargained and sold assigned and set over and by these presents do for me and my heirs give grant bargain and sell assign and set over unto the said Hen Hatch his heirs executors administrators and assigns as well this present indenture of lease as also the original indenture and all other deeds and writings thereto belonging as also the cottage or tenement curtilage and yard thereto belonging with their and every of their appurtenances to have and to hold the present indenture as also all other leases together with the cottage or tenement curtilage or yard thereto belonging with the appurtenances unto the said Hen Hatch his executors administrators or assigns for and during all the rest residue and remainder of the said term of one thousand years therein yet to come and unexpired and I the said Wm Newton do hereby covenant and promise for myself my heirs executors and administrators and for every of them that the said Hen Hatch his executors administrators and assigns shall from time to time and at all times forever hereafter peaceably and quietly hold and enjoy the within mentioned premises and every part thereof for and during all the rest residue and remainder of the within mentioned term of one thousand years yet to come and unexpired without the lawful let suit trouble molestation of the said Wm Newton his executors administrators or assigns in witness whereof I the said Wm Newton have hereunto put my hand and seal the 30.4.1688 mark Wm Newton sealed and delivered in the presence of G Toller Robt Potter mark Edw Warin
