and furthermore whereas at a court here held 2.4.1624 Robt Davie and Kath his wife were admitted tenants of the lord to themselves and the heirs of the said Kath to one messuage or customary tenement with adjoining curtilage called Greenes tenement and also to one garden sometime parcel of one complete tenement called Jakes lying between the tenement late Hen Pullen called Campions and the said tenement called Jakes according as it is shown by the division by the meets and boundaries and all buildings pertaining to the said messuage with appurtenances as is clearly shown by the said court roll now to this court came the said Robt Davie and Kath in person and Kath herself being solely and secretly examined by the said steward according to the custom in consideration of the marriage performed and solemnised between Sam Newton and Margt daughter of the said Robt and Kath they surrendered into the hands of the lord by the hands of the said steward the said messuage and other premises with appurtenances to the use of the said Sam Newton and Margt his wife and the heirs of their bodies legitimately procreated and in default of such issue the remainder thereof to the use of the said Robt and Kath and the heirs of the said Kath forever whereupon the said Sam Newton and Margt his wife came here into court and humbly sought admittance to whom the lord by the said steward granted and delivered seisin by the rod to have and to hold the said messuage and other premises with appurtenances to the said Sam and Margt and the heirs of their bodies etc from the lord by the rod at the will of the lord by the rents services and customs thereunto belonging and by right accustomed etc
